By accepting these Terms — including by checking the box at sign-in or by using the App — you enter into a binding agreement with us. You also consent to receive email communications from us about the Service and the games you opt into, as described in the Privacy Policy and Section 3.
You must be at least 13 years old to use the App. If you are under 18 (or the age of majority where you live), you may use the App only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. We do not knowingly allow children under 13 to create accounts or submit photos or location data.
Vistigo is a location- and time-based photo game. You receive a randomized board of squares. To claim a square you take a live photo in the App. When you submit a claim, the App records your device's GPS location (unless the game is set to "play anywhere") and a server timestamp, and sends your photo to an automated image-recognition service to check whether it matches the square. The center square is earned by answering a trivia question. Claims that do not pass verification are not awarded. Verification is automated and may be imperfect; we may also use human review.
The App encourages you to move through the real world and take photos. Your safety and the safety and rights of others are your responsibility. By using the App you agree that:
You agree not to: cheat or defeat verification (e.g. spoofing GPS, altering photo metadata, submitting photos not taken live in the App, photographing a screen, using emulators or automation, or sharing trivia answers); upload content that is illegal, infringing, obscene, sexual (especially involving minors), hateful, harassing, or that depicts or encourages unsafe or illegal acts; photograph people without appropriate consent, or use the App to stalk, harass, or harm anyone; violate any law or third-party right; or interfere with, disrupt, reverse engineer, or gain unauthorized access to the App or other users' data. We may remove content, disqualify claims, and suspend or terminate accounts that violate these Terms.
You keep ownership of the photos you submit. To operate the game you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, analyze (including by automated and AI-based image recognition), reproduce, and display your content for the purposes of providing, verifying, securing, and improving the Service and showing your boards and results back to you. You represent that you have the rights to submit your content and any consents needed from people shown in your photos. We do not claim ownership of your photos and do not sell them.
If a game or promotion offers prizes, additional official rules will be provided at that time (eligibility, odds, value, how winners are chosen and verified, and any "no purchase necessary / void where prohibited" terms). We may verify eligibility and disqualify claims that violate these Terms.
The App is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. Location data and automated image recognition can be inaccurate; do not rely on the App for navigation, safety, or emergencies. To the fullest extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, or consequential damages, or for personal injury or property damage arising from your use of the App or your conduct in the physical world. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You may stop using the App and request deletion at any time. We may suspend or terminate access for any reason, including violation of these Terms. We may update these Terms; material changes will be notified in the App or by email and reflected in the "Last updated" date. These Terms are governed by the laws of the United States and the state in which Vistigo's operator is established, without regard to conflict-of-laws rules.
To provide and run the game (verify claims using your location, the server timestamp, and automated analysis of your photo); to communicate with you about the Service (sign-in links, gameplay and account notices, and updates about games you opt into); for safety, security, and anti-cheating; to improve the Service; and to comply with law.
To verify that a photo matches a square, we send the photo to an automated image-recognition service — currently Anthropic (Claude) — which returns a match decision and confidence score. We and our processors do not use your photos to serve you advertising, and we do not sell them.
We do not sell the personal information we collect, and we do not share it for cross-context behavioral advertising. We use your email to communicate with you about the Service, which you opt into by accepting these Terms — not to sell or rent to third parties. If this ever changes, we will update this Policy and obtain any consent the law requires.
We share personal information only with service providers that run the App on our behalf and are bound to protect it (for example: Supabase for database, authentication, and photo storage; Vercel for hosting; Anthropic for photo verification; and our email provider); as required by law or to protect rights and safety; and in connection with a business transfer, subject to this Policy. We do not sell your data.
We keep your information while your account is active and as needed to provide the Service, then delete or de-identify it within a reasonable period unless a longer period is required for legal or security reasons. We use encrypted connections, access controls, private photo storage, and server-side verification (so sensitive values like trivia answers are never exposed to other players). No system is perfectly secure.
The App is not directed to children under 13, and we do not knowingly collect their personal information. Because the App uses photos and location, users under 18 should play only with a parent's or guardian's consent and supervision. If you believe a child provided us information without proper consent, contact us and we will delete it.
